This Constitution will be imposed in its totality the tenth of October of Nineteen Forty. In the accordance made by the Parliament in session on the twenty seven of April of Nineteen Forty and in homage to the memories of the Founding Fathers who signed the Constitution of the Republic In Arms the Tenth of April of Eighteen Sixty Nine. We certify: That the Constitution of the Republic of Cuba, signed in the historic town of Guaimaro, in the province of Camagüey, on the day first of July of nineteen forty, has been promulgated by the President of the Convención Constituyente, on the footsteps of the Capitolio Nacional, of La Habana, on the fifth day of July on nineteen forty. And for the remission of the Official Gazette of the Republic, it has been expedite the present in La Habana, Capitolio Nacional, on the fifth day of July in 1940. -Dr. Alberto Boada Miquel, Dr. Emilio Núñez Portuondo. Visto Bueno: Dr. Carlos Márquez Sterling y Guiral, President of the Convención Constituyente. LAW NUMBER 14, ON THE 18 OF DECEMBRE OF 1946, HAS BEEN MODIFIED THE SECOND PARAGRAPH OF ARTICLE 98 OF THE CONSTITUTION OF 1940, MAKING CLEAR OR INTERPRETING SAID ARTICLE MIGUEL A. SUÁREZ FERNÁNDEZ, President of the Congress of the Republic of Cuba, has been promulgated in the Official Gazette of the Republic the twentieth day of December of 1946. I AM LETTING BE KNOWN: that the Congress of the Republic of Cuba, executing the rights granted by the parenthesis b) from article 285 of the Constitution, by the proposition del artículo 285 de la Constitución, mediante proposición subscribed by one quarter of the members of the Senate, approved by the session given the eleventh day of December of 1946, corresponding to two ordinary Legislation, and with the favorable vote from two third of the total members of both bodies of colegislators, conformed with the second paragraph of article 286 of the Constitution, the following:

 

SPECIFIC REFORM

 
The second paragraph of article 98 from the Constitution of the Republic declares: In all elections or referendums the majority of votes legally cast, with the exceptions established by the Constitution. The results will be officially made public immediately after it is known by the organizers. I ALSO MAKE KNOWN: that the Congress has agreed, as the interpretation of article 98 of the Constitution, that by canceling the word "absolute," it will be understood that the majority will be the one that corresponds to the votes cast for each candidate, in consequence to proclaim the candidate who the most numbers of votes has got in the election or referendum. SO I ORDER: to be done and executed the present accord in all its parts.
